1. Introduction

This User Agreement ("Agreement" or "Terms") is a legally binding contract between you ("User," "you," "your") and EyeRxCraft ("we," "our," "us"). It governs your access to and use of the EyeRxCraft web application (the "Application"). By registering for an account or using the Application, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with this Agreement, you must not use the Application.

EyeRxCraft is a digital tool designed to assist qualified eye care professionals in generating and managing digital eye prescriptions. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

2. Eligibility

The Application is intended exclusively for use by certified and licensed Eye Health Care Professionals, specifically Optometrists and Ophthalmologists, who are adults and legally authorized to issue medical prescriptions in their jurisdiction. By creating an account, you represent and warrant that:

• You are a certified Optometrist or Ophthalmologist.
• You possess a valid, current license and registration to practice in your region.
• All professional details you provide are accurate, complete, and verifiable.

We reserve the right to suspend or terminate any account if the information provided is found to be inaccurate, fraudulent, or in violation of these eligibility requirements.

3. Account Creation & User Responsibilities

To use the Application, you must register for an account. You agree to:

• Provide true, accurate, current, and complete information during registration.
• Maintain the strict confidentiality of your account password and other login credentials.
• Accept full responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account or any other security breach.

EyeRxCraft reserves the right to verify user identity and credentials to maintain the integrity of the platform.

4. Professional Responsibilities

You acknowledge that EyeRxCraft is a supportive tool and is not a substitute for your professional skill, knowledge, and clinical judgment. As a user, you agree that:

• You are solely responsible for the accuracy, clinical appropriateness, and completeness of any prescription data you enter and generate.
• You will independently verify and validate all outputs from the Application before providing them to a patient or entering them into an official medical record.
• EyeRxCraft is not responsible for any clinical errors, and you will not hold us liable for any outcomes related to prescriptions generated via the Application.
• You will comply with all local medical regulations, ethical standards, and professional guidelines in your practice.

5. Acceptable Use Policy

You agree to use the Application only for its intended professional purpose. The following activities are strictly prohibited:

• Creating, storing, or distributing fake, fraudulent, or misleading prescriptions.
• Misrepresenting your professional identity or credentials.
• Attempting to gain unauthorized access to the Application’s systems or another user’s account.
• Sharing, selling, or transferring your login credentials to any other individual.
• Using the Application for any unlawful, unethical, or malicious purpose.
• Decompiling, reverse-engineering, or otherwise attempting to discover the source code or underlying structure of the Application.

6. Intellectual Property Rights

All rights, title, and interest in and to the EyeRxCraft Application—including its branding, logos, design, user interface, text, and source code—are the exclusive property of EyeRxCraft and its founder. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application strictly in accordance with these Terms. You may not copy, modify, reproduce, resell, or redistribute any part of the Application or its content without our express written permission.

7. Data Handling & Privacy

We are committed to protecting data as a core principle. Our data handling practices are as follows:

• Professional User Data: We securely store the professional profile data you provide during sign-up (e.g., name, email, clinic name) to manage your account.
• Patient Data: EyeRxCraft does NOT store, process, or transmit any patient-identifiable information or clinical data to our servers. All such information remains locally within your web browser’s environment.

8. Disclaimers

The Application is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding its operation. Specifically, you acknowledge that:

• EyeRxCraft does not provide any form of medical diagnosis, advice, or treatment recommendation.
• All outputs, including AI-generated suggestions, are entirely dependent on the data you enter and must be professionally verified.
• We do not guarantee 100% accuracy, uptime, or an error-free experience.

9. Limitation of Liability

To the fullest extent permitted by law, EyeRxCraft, its founder, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for medical errors, loss of data, loss of profits, or business interruption, arising out of or in connection with your use or inability to use the Application.

10. Service Modifications

We are constantly working to improve the Application. We reserve the right to modify, update, suspend, or discontinue any feature or part of the service at any time, with or without notice. We may also perform maintenance that could affect availability. We will not be liable to you or any third party for any such modification, suspension, or discontinuance.

11. Termination of Account

We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate any of the terms in this Agreement. You may also terminate your account at any time. Upon termination, your license to use the Application ceases, and we may delete your professional profile data in accordance with our data retention policies, except where legally required to retain it.

12. Governing Law

This Agreement shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under this Agreement will be brought exclusively in the courts located in West Bengal, India, and you consent to the personal jurisdiction of such courts.

14. Acceptance of User Agreement

By creating an account and using the EyeRxCraft Application, you acknowledge that you have read, understood, and unequivocally agree to be bound by this User Agreement. If you do not agree with these Terms, you must immediately cease all use of the Application.
